These Terms of Service ("Terms") govern your use of the Mosaic mobile application operated by Mosaic Anchor LLC ("we," "us," "our"), a Florida limited liability company. By creating an account you agree to these Terms.
By creating an account or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
You must be at least 13 years old to use MosayIt Family. By creating an account you confirm you meet this age requirement. Users under 18 should have parental awareness and consent. We reserve the right to terminate accounts of users found to be under 13.

You own the audio and video recordings you create in MosayIt Family. We do not claim ownership of your memories.
By using the App you grant Mosaic Anchor LLC a limited, non-exclusive, royalty-free license to store, process, and display your recordings solely for the purpose of providing the service to you and your family group. This license ends when you delete your content or close your account.

The App uses automated safety tools to detect harmful content. Content that violates these Terms may be removed and the associated account may be suspended or terminated. We are not obligated to review all content but reserve the right to do so for safety purposes.
We have zero tolerance for child sexual abuse material. As required by federal law (18 U.S.C. §2258A), apparent child sexual abuse material is reported to the National Center for Missing & Exploited Children (NCMEC), preserved as required by law, and referred to law enforcement. Associated accounts are terminated immediately.
The App uses artificial intelligence technology to generate and enhance certain content and features, including personalized prompts and suggestions. By using the App, you acknowledge and agree that we may use your recordings, responses, and in-app activity to personalize the prompts, features, and experience shown to you and your family within the App. AI-generated content is provided as suggestions only — we make no representation that it is appropriate for every family or situation. We are not responsible for the suitability or accuracy of AI-generated content. Your recordings and personal memories are never used to train AI models.
Mosaic is an interactive computer service. Users — not Mosaic Anchor LLC — are the sole speakers and publishers of their recordings. We do not review, endorse, or adopt user content as our own. To the extent permitted by 47 U.S.C. § 230 (Communications Decency Act), Mosaic Anchor LLC is not liable for content created or uploaded by users.
Recordings in Mosaic are private to your family group and are not publicly broadcast. You are solely responsible for ensuring your recordings comply with applicable laws, including obtaining any necessary consents from people you record.
If you believe content in the App infringes your copyright, send a written notice to our designated DMCA agent including: (1) identification of the copyrighted work; (2) identification of the infringing material and its location; (3) your contact information; (4) a statement of good-faith belief that the use is unauthorized; (5) a statement under penalty of perjury that the information is accurate and you are the rights holder or authorized to act on their behalf; and (6) your physical or electronic signature.

We will respond to valid takedown notices promptly. Counter-notices and repeat-infringer termination follow the procedures set forth in 17 U.S.C. § 512.
All intellectual property in the App — including but not limited to its source code, design, architecture, algorithms, AI models, personalization systems, and proprietary methods — is owned exclusively by Mosaic Anchor LLC and protected by U.S. copyright, trade secret, and other applicable intellectual property laws.
By using the App you acknowledge that you may be exposed to proprietary features and methods. You agree to keep such information confidential and not to use it to develop, directly or indirectly, any competing product or service.
You agree not to publicly disclose unreleased features, functionality, or beta content without our prior written consent.
Nothing in these Terms grants you any right, title, or interest in the App's intellectual property beyond the limited license to use the App as described in these Terms.
We may suspend or terminate your account if you violate these Terms, with or without notice. You may delete your account at any time from Profile Settings. Upon termination, your license to use the App ends and your personal information and recordings will be deleted within 14 days. We may retain anonymized, non-identifiable usage data (such as aggregate feature usage and interaction patterns) for product improvement purposes. Such data cannot be linked back to you and is not subject to deletion requests.
The App is provided "as is" without warranties of any kind, express or implied. We do not guarantee:
Couples Capsule — Safety Notice: The Couples Capsule and Hive features are designed for use within safe, mutually respectful relationships. These features are not appropriate for relationships involving intimate partner violence, coercive control, manipulation, or active betrayal trauma. In those contexts, messages of affection may be harmful rather than helpful. If you are in an unsafe relationship, please seek support from a qualified professional before using these features.
To the maximum extent permitted by applicable Florida law, Mosaic Anchor LLC and its officers are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including loss of data or recordings.
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any legal action not subject to arbitration below shall be brought exclusively in the state or federal courts located in Florida.
BINDING ARBITRATION — PLEASE READ: Any dispute arising from these Terms or your use of the App will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, held in Florida. You waive your right to a jury trial and to participate in any class action. Either party may still seek emergency injunctive relief in a Florida court to prevent irreparable harm pending arbitration.
Opt-out: You may opt out of arbitration within 30 days of first creating your account by sending written notice to info@mosaic-anchor.com with subject line "Arbitration Opt-Out" and your account email. Opting out does not affect any other term.
We may update these Terms from time to time. We will notify you by updating the "Last updated" date and, for material changes, by in-app notice. Continued use of the App after changes constitutes acceptance.

The App's Vault and related features let you record messages and memories for delivery to a named recipient at a future date, a life event, or upon your passing ("Legacy Delivery"). This section explains how we handle Legacy Delivery and your digital assets after you pass away, consistent with applicable state law governing fiduciary access to digital assets.
Your designation controls. The unlock option you choose at the time of recording (date, event, or "upon passing") is your instruction to us for that content, and — to the extent permitted by law — takes priority over a general request from a family member, executor, or other fiduciary that conflicts with it. Naming a Legacy Contact in the App's Settings is likewise an instruction to us through the App's designated tools, and identifies the person you trust to initiate the verification process described below.
Verification before release. Before releasing any content designated for delivery upon your passing, we require reasonable verification, which may include a copy of a death certificate or comparable official documentation, submitted by a family circle administrator and reviewed by our team. We may decline or delay release if we are unable to reasonably verify the triggering event.
If you have not made a Legacy Delivery designation. If your account contains content without a specific delivery designation, access after your passing will be handled according to the priority order set by applicable law: (1) your instructions through the App's designated tools (as above), (2) a valid will, trust, power of attorney, or court order presented to us by your legal representative, and (3) these Terms, where the law allows us to rely on them.
No liability for good-faith compliance. We will not be liable for acting in good faith on a Legacy Delivery designation, or on documentation reasonably believed to be genuine, consistent with applicable law.
Verification process is provided on an as-is, evolving basis. Our Legacy Delivery verification process — including any review timelines, hold periods before release, or notification steps — is provided on an as-is, commercially-reasonable-efforts basis and continues to be developed and refined. To the maximum extent permitted by law, we disclaim liability for delays, errors, or unintended outcomes arising from this process while it is being improved, and we do not guarantee any particular timeline for review, hold, or release.
